Dr. Rajan Mahtani seeks for Judicial Review against the injustice done to him

It is a well-known fact the Dr. Rajan Mahtani was arrested on June 2 2015 on account of a case which was previously confirmed to be ‘permanently closed’ by the Attorney-General. However, a sickening event took place when the Ventriglia family was able to use their money power and bring back this irrelevant case back to life with the aid of some corrupt government officials.

Soon after Dr. Mahtani was released, he ensured this question was raised in front of the nation and ensure that a judicial review of this event is carried out by higher law enforcing authorities. The position whose decision to issue the arrest warrant is being challenged is the Director of Public Prosecutions (DPP).

The charges which were placed on Dr. Rajan Mahtani revolved around prosecuting him under forgery for obtaining the share of the Zambezi Portland Cement Factory. For people who are already aware of the history of ZPC, they would recall that the incident is same as the one which took place in 2012 and during that phase, the Attorney-General had stated that all proceeding regarding the claim of forged signatures are ‘permanently closed’.

Legal provisions for Certiorari and Prohibition have come into this case as Dr. Rajan Mahtani looks forward to receive justice. The defamation campaign against Dr. Rajan Mahtani has been going on for a very long time. However, it is time that Dr. Rajan Mahtani has decided to send a strong signal to the conspirators that cheap tactics will no longer work for them. If the Ventriglia family thinks that they can snatch the ZPC from its legal owners, it will have to come down on an equal platform and have everything settled under the Law.

Let the truth about the Zambezi Portland Cement Factory be unfold

It is time that the people of Zambia and the rest of Africa are introduced to the truth. For long, the Zambezi Portland Cement Factory has been seen as a topic of conflict as the Ventriglia family continues to claim its ownership and disregard the fact that Finsbury Investments holds a stake of 58% in the same factory.

The desperation of the Ventriglia family has reached a level where they have decided to bribe and use corrupt actions to ensure that Dr. Rajan Mahtani is put behind the bars and their shameful deeds remains in the shadow. However, with God’s grace Dr. Rajan Mahtani was released from jail as the registered case didn’t have anything to show as evidence. Nevertheless, Finsbury Investments have plenty to show as they are confident of their proof. Attached below is an evidence which shows that the transfer of shares were made and the Ventriglia family has voluntarily given 58% equity ownership to the Finsbury Investments:

Dr. Rajan Mahtani becomes a victim of ‘Failed Experiment’- 2015

After the demise of Michael Sata, the people of Zambia looked forward to find a leader who was as inspiring as the former. However, with the arrival of President Edgar Lungu, the same hope is now shattered. Gavin Sinkala, the Executive Director of ACOZA, has stated that Edgar Lungu has simply ‘surrendered’ his vested powers to Rupiah Banda and is acting as a puppet in her hands.

Dr Rajan mahtani

Rupiah Banda is one of the most corrupt persons in Zambia who ensures that her powers are used in the best possible ways to generate personal gains. The Ventriglia family has always maintained good relations with her because she is the right person for them to get things done with ‘money power’. In 2012, the reason behind Dr. Rajan Mahtani’s arrest was a partnership between Rupiah Banda and the Ventriglia family. Similarly, the arrest of Dr. Mahtani on June 2015 was politically motivated as President Edgar Lungu did nothing to safeguard the interest of an innocent businessman Dr. Rajan Lekhraj Mahtani.

The need of the hour for Zambia is to find a person who can acknowledge the designation of the President and abide the principles of truth and honesty. The RB has manipulated the system and has tried its level best to ensure that Zambia is ruled by certain people.

Dr. Rajan Mahtani’s Finance Bank is set to make a difference

The Finance Bank of Zambia has been an integral part of Zambia’s economy for the past two decades. During this time, the bank is not only financing numerous development projects, but has also offered employment to numerous people of Zambia and abroad.

The bank has already made a salary hike of K 730 for the existing employees from the month of January 2015. Moreover, with expansion programs there are possibilities in an increased demand of workforce which currently stands at 750.

Making false stories won’t stop Dr. Rajan Mahtani

On Friday, May 22 2015 Dr. Rajan Mahtani took a step which shocked the whole world. Dr. Mahtani filed a petition in the Lusaka High Court for dissolving the ZPC since, there was a constant fight between the actual owners, Finsbury Investments and minority shareholder, the Ventriglia family with respect to control over management.

Dr Rajan Mahtani

The series of trouble started in April 2015 when the Ventriglia family took over the management of ZPC by forcefully entering into the premise of the factory. Notwithstanding the orders of the High Court, the Ventriglias went to the extent of tearing the injunction papers and then dismissing them on account of being useless. Apart from this shameful deed, the Ventriglias also dismissed PACRA’s record which states that Ventriglia family is only a minority shareholder with a stake of 42% and Finsbury Investments are the actual owners of the ZPC with a 58% stake.

The only solution to this problem was dissolution of ZPC which seems to be the centre of the problem. From the perspective of employees, they will be now safe from the clutches of the Ventriglia family who make sure that the employees work every day, but offer no salary to them at the end of the month. However, when the Ventriglia family learnt about this news, they immediately published a new story under ‘Lusaka Times’ which states that Dr. Rajan Mahtani cannot dissolve the Zambezi Portland Cement because he is not the true owner of the factory.

10% hike in Salary of Zambezi Portland Cement’s employee- A Sham

The Ventriglias have announced that the existing employees of the Zambezi Portland Cement Factory will now be offered a hike of 10% on basic pay. The announcement came shortly after it was revealed that the wages for the month of April has not been offered to the existing employees of the factory. Since the factory was taken over in ‘mafia style’ on April 7, 2015, the affairs of the factory are being managed by Ventriglia family whose only objective is to transfer money from factory cash box to their personal bank accounts.

Zambia Reports, a loyal supporter of the Ventriglias since it gets heavily funded by the latter has portrayed this news as a big achievement. Additionally, it has also done its routine work of defaming Dr. Rajan Mahtani by writing imaginative stories in his name and claiming that he had ruined a major part of the factory.

However, the truth is known to most of the people in Zambia and the rest of Africa. People are well aware of the attitude that the Ventriglia family possesses towards the employees of ZPC. Today they have announced an increment, but tomorrow the same may be considered as invalid and the workers will once again be deprived of the right to receive monthly remuneration.

Life without wages for the workers of the Zambezi Portland Cement Factory

Life at Zambezi Portland Cement Factory has completely changed after the departure of Dr. Rajan Mahtani. The factory which once used to flourish with 700 employees has now become a prison for the same employees. Issues such as mistreatment of employees and non-payment of salary has started to develop.

May 1, commonly celebrated as Labour Day was full of worries for the employees of the Zambezi Portland Cement Factory as they were deprived of their last month’s salary. The present owner, the Ventriglia family is busy shifting the existing funds of the factory to their private bank accounts. Internal sources have revealed that there are seven family members of the Ventriglias who form an integral part of the factory and each of them withdraws US $ 40, 000 on an average. Additionally, money is also withdrawn on account of rental caps, which makes a big hole in the capital of the factory. On one incident, there was a transaction amounting to K2 billion which was transferred to the account of Antonio Ventriglia without producing any relevant explanation.

However, with no one to stop these proceedings, the Ventriglias are simply looting the factory and showing their true character after returning to Ndola. They were previously deported from Africa on account of being a threat to the prevailing harmony.

Dr. Rajan Mahtani is still an integral part of the Zambezi Portland Cement Factory- 2015

Recently, the attack of the Ventriglias and the Zambia Reports on the Zambezi Portland Cement Factory created a series of rumors in and around Ndola and the rest of Africa. On one hand, where the Ventriglias took the opportunity to steal the management of the ZPC, Zambia Reports continued to show its loyalty towards its funding party by way of publishing defamatory news against Dr. Rajan Mahtani.

Zambezi Portland Cement

Irrespective of the impact created by Zambia Reports, the truth has not been concealed yet. As per the documents of PACRA (Patents and Companies Registration Agency), the real owner of the ZPC is still the Finsbury Investments, who holds 58% of the shares of the unit. The Ventriglias belong to the minority group as their total shareholding compromises of only 42%. Their jealousy of not being able to participate in the management of the ZPC eventually led to a ‘Mafia Style’ attack on the premise of ZPC in the early hours of April 7, 2015. The attack witnessed the arrival of bandits who played an important role in implementing terror during the takeover.

Even though a legal injunction was produced by the officials on the scene, the same was torn into pieces and thrown in the face of the representative.

The Ventriglias face legal consequences for looting Zambezi Portland Cement- 2015

Some people may think that they are free to execute any operation in Zambia, irrespective of whether it is allowed by the law or not. The Ventriglias were one of such people who thought that stealing the management of the Zambezi Portland Cement Factory would be easy as they had the assistance of media and political figures. Sadly, what they ignored is the power of Zambian Law.

After disrespecting the injunction of the Zambian High Court on April 7, 2015, the Ventriglias have now been issued with a fresh notice that implements ‘an order for committal for contempt’. Though The Ventriglias were previously warned by the Zambian High Court, they took the initiative of making a ‘Mafia Style Invasion’ in the Zambezi Portland Cement Factory and snatched the management from the hands of Finsbury Investments, Dr. Rajan Mahtani, became the prime target during this incident and Zambia Reports kept on creating fake stories in his name.

A copy of the High Court’s order is attached below:

Zambezi Portland Cement Factory attacked in Mafia Style- 2015

The Zambezi Portland Cement Factory in Ndola was attacked during the early hours of the day by the Ventriglia family. Godfather Antonio Ventriglia, a minority shareholder in Zambezi Portland, hired some policemen from Coperbelt and Lusaka and captured the cement factory.

The incident took place in the early hours so that none of the high authority officials could reach the place on time. The present employees were vacated and now the whole cement factory is fenced by the policemen whom Ventriglia has hired.

Zambezi Portland Cement

The Ventriglia family owned 42% of the shares of the Zambezi Portland cement and were often jealous of the fact that they belonged to the class of minority shareholders. In order to have complete control over the cement factory, they decided to take it by force by bribing some politicians and hiring policemen. When an official presented a court injunction that restricted them to participate in the plant’s operation, the injunction was torn into pieces and thrown in the face of the person who had presented it.

Finsbury Investment owns 58% of the shares of Zambezi Portland Cement. Dr. Rajan Mahtani, an integral part of Finsbury Investment has often been warned and threatened by the Ventriglias. This also includes numerous defamation charges on account of money laundering, forgery and malpractices.
