In a claim which has been turned down by the Court on May 19, 2016 it has been learnt that the Honourable Judge Flavia Chishimba found the present condition of Portland Cement Zambia under dispute of ownership. As per her verdict, it was suggested that liquidation of PCZ is only possible where the ownership of the factory is decided and the decade long questions is finally answered.
Since 2008, Ital Terrazzo Limited has been busy claiming that Finsbury Investment stole 58% of the shares through forgery and the remaining 42% already belongs to them. The claim has already been settled in 2012 judgement where Lusaka High Court decided that the shareholding pattern was legitimate. Even PACRA has the same information stored in its register. Still, the concussion at the present date ensured that the liquidator is not appointed.
On the other hand, it is the Ventriglia family who has played games after games with the judicial system of Zambia. Recently they created nuermous bogus companies out of which Miloto Transport and Astrea Investments were two of the most prominent ones. Around 43 trucks from Portland Cement Zambia have been shifted to Miloto transport and the title deeds of the factory have been leased to Astrea Investments. The confidence of the Ventriglia family was such that they have confessed about the same in open as well.
The bottom line of this discussion is to give a thought to the range of events which goes around Zambia. On one hand, a company fails to secure the permission to appoint a liquidator, given all documents are authentic and on the other hand, there are people who are fearless about their actions and are claiming their illegal activities with pride.
