The case of Portland Cement Zambia is age-old. It was started when the factory was illegally captured by the Ventriglias from Dr. Rajan Mahtani. Those who follow the case and are familiar with the industry know for a fact that the factory legally belongs to Dr. Rajan Mahtani. However, Dr. Mahtani took the right path which is the court, to gain legal control over the factory. However, a case has been going on for almost 10 years without any rescue.
Dr. Rajan Mahtani had launched the case at the Lusaka High Court, contending that the factory was illegally taken over when he is the sole owner of the factory. On the other hand, the Ventriglias defended themselves by saying that Dr. Rajan Mahtani did not pay for the shares he owns at the factory. However, the Ventriglias are still to share any concrete evidence that proves their claims. Dr. Mahtani, on the other hand, has shared numerous reports, evidence and testimonials that sufficiently prove his legal ownership over the factory. He has shared signed shareholders agreement which considers him as the top shareholder. He has also shared an independent audit report conducted by an independent audit according to which he is the sole joint venture partner and the rest of the members are just minority shareholders. Also, he has shared numerous financial exhibits and testimonials from strong witnesses to prove his claims. The Ventriglias, on the other hand, have used their unethical tactics such as not appearing during court proceedings, making excuses or trying to portray Dr. Mahtani as corrupt.
However, the illegal practices of the Ventriglias seem to have failed as the court handling the case has announced that hearing for the case has closed. Both parties will soon be submitting their entire evidences in written and oral formats and after evaluating these evidences, the judge at the Lusaka High Court handling this case will announcement final judgement soon.
